Terms of Service

1. Eligibility

• You must be at least 18 years old to access or use the Platform in any capacity.
• Buyers must also be of legal age to purchase these items in the jurisdiction where they live, if that age is higher than 18.
• You may not use the Platform if you have previously been suspended or removed from it, or if doing so would violate any law that applies to you.
• We may request proof of age from any user at any time and may restrict access until it is provided.

2. Accounts and security

• Provide accurate, current information and keep it up to date.
• Each person may hold one account. Accounts are personal and may not be sold, shared, or transferred.
• You are responsible for keeping your credentials confidential and for all activity under your account.
• Notify us immediately at legal@orderfrky.com if you suspect unauthorized access.

3. Seller verification

Every seller must complete government-issued ID and age (18+) verification through our verification partner, Veriff, before listing any item.

• Listings cannot be created or published until verification is approved.
• The verified identity must match the account holder. Verification on behalf of another person is prohibited.
• We may require re-verification at any time, including when account details change or activity appears inconsistent with the verified identity.
• We may suspend selling privileges, hide listings, or hold earnings while verification is pending, has failed, or is under review.

4. Seller agreement

By listing an item, you represent and agree that:

• You personally own the item and have the right to sell it.
• Your title, photos, description, condition, size, and any wear details are accurate and not misleading.
• The item and listing comply with these Terms and our Prohibited Items & Content policy.
• You will ship each order within 5 business days of payment.
• You will ship using a label purchased in the app, or provide a valid carrier tracking number for every shipment.
• You will package items securely and discreetly, and will not include personal contact details or off-platform payment information in packages.
• You are responsible for any taxes owed on your earnings, unless we are required by law to collect them.

Labels purchased in the app print a platform return address so your home address is not shown to buyers.

5. OrderFrky as merchant of record

OrderFrky is the merchant of record for all purchases on the Platform. Buyers pay OrderFrky through our third-party payment processor, and OrderFrky pays sellers from their earnings under Section 6. Sellers do not accept payment from buyers directly. Your card statement will show a discreet billing descriptor rather than a seller name or item description.

6. Fees and payouts

• Seller earnings equal the sale price received, minus platform fees and the cost of any shipping labels purchased in the app. Current fees are shown in your seller dashboard before you list.
• The minimum withdrawal amount is $20.00 USD.
• Earnings become available for withdrawal once the order has shipped and any applicable review period has passed.
• We may hold, delay, or reverse earnings related to open claims, disputes, chargebacks, suspected fraud, verification issues, or policy violations until the matter is resolved.
• You must provide accurate payout details. We are not responsible for losses caused by incorrect details you supply.
• We may change fees with notice. Changes do not apply to orders already paid.

7. Buyer terms

• Because of the personal nature of the items sold, all sales are final. Returns and refunds are available only if an item is not delivered or is materially not as described.
• You must open a claim within 14 days of the delivery date shown by tracking. For non-delivery, open a claim within 14 days after the estimated delivery date.
• We review claims using tracking data, listing details, messages, and any evidence provided. Our decision on a claim is final for purposes of the Platform.
• You must provide an accurate shipping address. We are not responsible for delivery failures caused by an incorrect address.
• Items are for personal use. You may not resell items while representing them as purchased directly from a seller.

8. Prohibited items and content

Certain items, services, and content are not allowed on the Platform under any circumstances. The full list, including how we enforce it, is in our Prohibited Items & Content policy, which forms part of these Terms.

9. Content rules

• No nudity or sexual imagery in listing photos, profile images, banners, or any other uploaded media.
• No explicit or sexual language in titles, descriptions, bios, reviews, or messages.
• Content is screened by automated keyword and image filters and may be reviewed manually. Content may be blocked at upload or removed afterwards.
• Content that violates these rules will be removed, and repeated or serious violations may lead to suspension or termination.

10. No off-platform payments or contact

All transactions must be completed through the Platform. You may not request, offer, or accept payment outside OrderFrky, or share or solicit phone numbers, email addresses, social media handles, payment handles, or other contact details in listings, profiles, or messages. Attempts to move a transaction or conversation off-platform may result in removal, suspension, and loss of protection for that transaction.

11. Privacy and discretion

We are built to keep buyers and sellers private. Shipping addresses, message contents, and bank details are encrypted at rest, and sellers ship using a platform return address. You agree not to collect, share, or misuse another user's personal information. See our Privacy Policy for details.

12. Chargebacks and fraud

• Buyers should contact us or open a claim before disputing a charge with their bank. Filing a chargeback for an order that was delivered as described is a breach of these Terms.
• We may suspend accounts associated with chargebacks, payment fraud, stolen payment methods, or abuse of the claims process.
• If a chargeback or fraud loss is attributable to a seller's breach of these Terms, the amount may be deducted from that seller's earnings.
• We may report fraud to payment processors, card networks, and law enforcement.

13. Suspension and termination

We may restrict, suspend, or terminate any account, remove any content, or cancel any order at any time if we reasonably believe you have violated these Terms, created risk or legal exposure for OrderFrky or other users, or if required by law or our payment partners. Where an account is terminated, we may withhold earnings needed to cover refunds, chargebacks, fees, or losses. Remaining legitimate earnings will be paid out subject to verification and applicable law. You may close your account at any time from your profile settings or by contacting us.

14. Your content and licence

You keep ownership of the photos, text, and other content you upload. You grant OrderFrky a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, and display that content for the purpose of operating, promoting, and improving the Platform. This licence ends when the content is deleted, except for copies retained for legal, safety, or dispute purposes. You confirm you have all rights needed to grant this licence. The OrderFrky name, logo, and Platform software are owned by OrderFrky and may not be used without permission.

15. Disclaimers

The Platform is provided "as is" and "as available". To the fullest extent permitted by law, OrderFrky disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Items are sold by independent sellers. We do not guarantee the condition, history, or authenticity of any item beyond the protections described in Section 7, and we do not guarantee uninterrupted or error-free service.

16. Limitation of liability

To the fullest extent permitted by law, OrderFrky and its officers, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Platform. Our total liability for any claim relating to the Platform is limited to the greater of the amount you paid to or earned through OrderFrky in the 12 months before the claim arose, or $100 USD. Some jurisdictions do not allow these limits, so they may not fully apply to you.

17. Indemnity

You agree to defend, indemnify, and hold harmless OrderFrky and its officers, employees, and partners from any claims, losses, liabilities, and expenses, including reasonable legal fees, arising from your use of the Platform, your content or listings, items you sell or buy, or your violation of these Terms or any law or third-party right.

18. Governing law

These Terms are governed by the laws of [STATE], United States, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in [STATE], United States, and you consent to their jurisdiction, unless applicable law requires otherwise.

19. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the version label and effective date above and notify you by email or in the app before the changes take effect. Continuing to use the Platform after that date means you accept the updated Terms.
